Rules Of Submission
General Conditions:
- The Scottish Borders Council through the Scottish Borders Memory Bank retains the right to choose and arrange work submitted,
and to remove work from the Scottish Borders Memory Bank website at its sole discretion
- You agree to only submit materials to which you have the copyright. You may not violate, plagiarise, or infringe on the rights
of third parties including copyright, trademark, trade secret, personal privacy, publicity or proprietary rights
- You may not submit any unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented,
racially offensive, or otherwise objectionable material
- The Scottish Borders Memory Bank retains the right to reject work which in their reasonable opinion is in breach of these
terms and conditions
- The Scottish Borders Memory Bank is under no obligation to publish the work submitted
- The Scottish Borders Memory Bank will need your full name, address and contact details for the purposes of our register of
copyright ownership. These details will not be passed on to any third party
- The material you submit will be stored in the archives of the Scottish Borders Memory Bank
- The Scottish Borders Memory Bank accepts no responsibility in connection with any work you submit to a third party i.e. not
the Scottish Borders Memory Bank
- We regret that we are unable to link from your work to any external sites
Rights:
- Warrant that it is your own original work and that you have the right to make it available to the Scottish Borders Memory
Bank for use in all media worldwide in perpetuity and to make it available to the organisations assisting with the Community
Archive Project for display, interactive access publicity purposes and archive retention
- Indemnify the Scottish Borders Memory Bank against all legal fees, damages and other expenses that may be incurred by them
as a result of your breach of the above warranty
- Grant the Scottish Borders Memory Bank the right in perpetuity to display the work on its website located at http://www.memorybank.org.uk,
which can be viewed internationally, and to store it on its servers and in its archive and to use in all media worldwide
- Agree to waive your moral rights in the work for the purposes of its submission to and use by the Scottish Borders Memory
Bank and also for use by the organisations assisting with the Scottish Borders Memory Bank
- Agree that the Scottish Borders Memory Bank shall not be responsible for any third party infringement of your rights in the
work, moral or otherwise, which may result from its submission to the Scottish Borders Memory Bank website. (What this means
is that you give the Scottish Borders Memory Bank the rights to use and display this work worldwide, and where you have copied
images or sounds off the net or elsewhere, you have permission to use this material. If these rights have not been obtained
and the owners attempt to sue the Scottish Borders Memory Bank for breach of copyright, you are responsible for all costs)
